Weitzel prosecutors lied

I have just finished reading the affidavit of Judge Thomas L. Kay, available on the Internet at: www.weitzelcharts.com/kayaff1.htm.

I believe that the prosecutors in the Weitzel case have now gone way too far. After reading the affidavit recently released by Judge Thomas Kay, one sees that these lawyers have lied repeatedly about events during the trial just to try to get rid of an honest and unbiased judge.

Of most interest to me is how they complained that Judge Kay told a (city) prosecutor that the revelation of the authoritative judgments of Dr. Perry Fine would "blow the state's case out of the water."

Davis County Attorney Melvin Wilson claimed in a sworn affidavit that Kay had said this in public, before the release of his decision on the matter in January of 2001. In fact, this was a private conversation between the judge and a lawyer, and it occurred after the release of the opinion.

The state's lawyers are dishonest. They were told by their own key expert witness, Brad Hare, that Dr. Fine was the much better qualified expert, and they then paid Fine to review the medical records. Dr. Fine said there was no crime, but the state ignored him and went on to use (now discredited) Hare to get Weitzel convicted. Then when the judge finds out about it and their misconduct is punished, they tell lies about what happened in court. I find this very offensive.

With these latest acts of downright perjury, prosecutors should resign or be forced from office or perhaps charged criminally.
