      Weitzel case pointless
 
            On Nov. 5, Davis County Attorney Melvin Wilson claimed that Judge 
      Thomas Kay's answers to his allegations proved that he should not be on 
      the Weitzel case. He makes this statement in a submission to Judge West. 
      Later, West reluctantly decided that Kay should recuse himself.
            Wilson and his cronies have created the very cloud hanging over this 
      case. They have repeatedly twisted the truth, grossly misrepresenting what 
      was said, making claims that are directly contradicted by the record in 
      the trial transcript. Judge Kay remained amazingly calm, sober and 
      honorable throughout this assault on his integrity. His affidavit 
      regarding Wilson's allegations was a dignified, direct assertion of facts. 
      Only facts. All should read it. It is available on the Internet at

            Wilson and the other state lawyers created a situation where the 
      judge's impartiality was questioned by their own lies and distortions. It 
      amounts to perjury. It is dishonest and deceitful. Nevertheless, the 
      innocent and upright Judge Kay's honest defense of his actions further 
      indicate that he is unbiased. Their futile attempts to redeem themselves 
      by attacking Dr. Weitzel, Dr. Fine and Judge Kay are self-serving.
            The recent revelation that Davis prosecutors were willing to offer 
      misdemeanors across the board in a plea bargain is telling.
            When will these lawyers cease criminalizing normal and appropriate 
      medical care? This case has done justice to no one.
